Writing for the Courtâs majority, Justice Henry Brown ruled that the law did not âdiscriminateâ among legal rights by race, but merely recognized a âdistinctionâ between races âwhich must always exist so long as white men are distinguished from the other race by color.â âŚThe ruling established the âseparate but equalâ doctrine that informs many statesâ decision to segregate public facilitiesâ schools, railcars, even drinking fountains.
