Anh A và Công ty X ký với nhau hợp đồng lao động có thời hạn 2 năm. Hết 2 năm, hai bên lại tiếp tục ký một hợp đồng thứ hai cũng có thời hạn 2 năm, hợp đồng kết thúc vào ngày 31/12/2018. Tuy nhiên, người phụ trách vẫn giao việc nên anh A vẫn làm việc bình thường đến ngày 31/3/2019. Do tình hình kinh doanh khó khăn nên ngày 1/4/2019 Công ty X mới tiến hành trả lương 3 tháng đầu năm cho người lao động nhưng anh A không được nhận lương. Kế toán giải thích rằng hai bên chưa ký hợp đồng mới nên dù anh A có làm việc cũng không được công nhận.
