Kelvin’s employer terminates his employment on the basis of allegations of
fraud made by another employee who, it was well known, desired Kelvin’s job.
Kelvin’s employer failed to carry out any investigations prior to his termination
and did not give Kelvin an opportunity to be heard. Had the employer done so,
Kelvin would have provided concrete evidence to illustrate that the claim of
fraud was untrue. Kelvin suffers injury to his reputation and is unable to obtain
other employment as a result. He wants to sue for substantial damages but there
is no unfair dismissal legislation in his country.
