At trial, the senders defend themselves by showing the material is not obscene in their home states. Can they still be convicted?

The CAN-SPAM Act and subsequent rules set down by the FCC prohibit only commercial e-mail messages being sent to wireless devices. It does not cover transactional/relationship messages, messages to facilitate a transaction the recipient has already entered into, or messages about political candidates or issues. Do you think the ban should be extended into any new areas? Why or why not?
