WYNN CASE Seven months ago Tara Wynn was injured in an automobile-bus collision. The accident occurred when the brakes on the bus failed, resulting in
the driver's inability to stop for a red light. The bus, in which Wynn was a passenger, was hit broadside by a car entering the intersection at the
green light. The bus, which was six-month old, was owned and operated by the City of Cedar Pines of Fairfield County, Connecticut. However, on
month after the accident, the bus manufacturer, Euro Motors, Inc., issued a recall on the bus because of a possible defect in the breaking
system. After the accident, Wynn did some internet research on Euro Motors, Inc. and found that several customers had complained about the
breaking system on its busses for more than one year prior to her accident. Wynn has requested that your firm represent her in personal injury
lawsuit for the injuries she sustained in the accident. Your attorney requested that you do some preliminary research to determine whether this
lawsuit should be accepted and, if so, whether any immediate action is needed.
To determine if this lawsuit shall be taken, please answer the following questions:
1. Who are the possible defendants to this action?
2. What are the possible causes of action to this lawsuit (state each COA and its elements).
3. Once ques 1&2 have been answered do an analysis for each possible defendant for each possible COA whether or not those COAS stand
4. What are the Statute of Limitations for each COA and see whether this changes if lit-litigating against a city and have the SOLS run?
