Scenario: Mr and Mrs Smith have pre existing conditions. Mr Smith had recent surgery for a knee replacement, Mrs Smith is hypertensive.
The couple were refused insurance and took their case to court.
Attorneys will need to present why the couple should not have been refused.
You will need to state the sections of the law that applies. You will assume
that we are using the law that applied in 2018.
The law details how much of their income should be applied for payment.
Assume that their gross salary is $80,000 per year and they do not want to
pay more than 2.5% towards insurance per month. What amount should they
be paying? Include that in your discussion you are going to present to the
judge.
Each attorney will have five minutes to present
The Judge will need to sum up the law, look at each attorney's presentation,
discuss points missed and decide whether the company was wrong for
refusing them and why. The judge will also decide damages (the amount to be
paid to the couple) and the maximum amount they should have had to pay to
the marketplace at their current gross salary.
