Officer Belkin had previously arrested Stephen for drug sales. Stephen was now out of jail and back
on the street. Officer Belkin saw Stephen standing next to a person making movements with his
hands that were consistent with the movements the officer had previously seen known drug dealers
make when they were exchanging money for drugs.
The officer stopped Stephen on the street after observing him engage in this behavior, suspecting
that Stephen was again engaged in the sale of illegal narcotic drugs, although Belkin did not see
what, if anything, was exchanged.
When asked what he was doing, Stephen replied, "just chillin."
