B. The term stare decisis when translated from Latin means "let the stars decide" meaning that the highest court must set the bar for establishing any precedents.
C. Precedent is an outdated concept in American law because the nature of crime and criminal defense is changing so quickly as a result of technology, so every criminal trial is now unique.
D. There is no relationship between stare decisis and precedent; stare decisis is specific to federal courts, and precedent applies only to municipal and state courts.
