Should Santa be arrested for breaking and entering

Saint Nicholas, popularly known as Santa Claus, is actually a character originated from Western Christian culture. He is also sometimes referred to as Messenger of Jesus. Well the thing is the man is not real, so no charges. But if he were real the most common charges against him would be breaking and entering people's home. Yeah so would surely get arrested. But Alas it's a fantasy!
