Before a protection act is created, the U.S. congress must first pass a law to allow it's creation. From there, the Environmental Protection Agency creates appropriate regulations for enforcement by state and local authorities.

The 1969, National Environmental Policy Act (NEPA) was based on the 1959 Resources and Conservation Act (RCA).

On 1 Jan 1970, President Nixon agreed to sign the NEPA into act. The law passed the President's Administrative Office's Council on Environmental protection . For all large federal decisions that have a substantial environmental impact, NEPA mandated that a comprehensive environmental assessment statement be prepared.

On July 9, 1970, President Nixon initiated an administrative reorganization into one authority, a new Environmental Protection Agency, that centralized most government environmental obligations
