Well the question is what did the child did? What crime did that child commit and how out of control is he or she?. I’m my personal opinion I would say yes, because a 12 year old child would be Abel to make decisions on their own. If a child of that age stole a candy, then no. But if a child commit a crime such as murder or not cooperating with the parent or guardian.
